Big blow for jobless Pitso Mosimane as former Orlando Pirates star forced to pay R7,9 million to Mamelodi Sundowns

    WHAT HAPPENED?

    Pitso Mosimane has been ordered to pay R7,912,905 to Mamelodi Sundowns in agents’ commission fees and seven percent interest per annum from May 10, 2021. 

    The South Gauteng High Court has ruled in favour of the Brazilians to recover part of the agents' commission fees paid to MT Sports when the coach joined Al Ahly in 2020. 

    The move to Egypt came just four months into his new four-year contract with Masandawana.

    THE RULING AGAINST MOSIMANE

    Judge Shanaaz Mia dismissed Mosimane's assertion that the High Court did not have jurisdiction to preside over the matter as he argued that the Premier Soccer League Dispute Resolution Chamber should have handled the case. 

    Also, a clause in Mosimane's new contract stated that Sundowns were entitled to reimbursement of the agents' commission for the remaining period of the deal should the coach leave the club before the expiration of the contract.

    “At the time the contract was signed, Mr. Mosimane was aware of this clawback clause and elected to sign the agreement, which afforded him an increased salary and benefits,” ruled Judge Mia as per SABC Sport.

     “The agreement was beneficial to him, and he was aware of the consequences of signing the agreement and the rights and obligations it contained.”

    THE BIGGER PICTURE

    This legal development comes at a time when Mosimane is unattached after leaving Iranian side Esteghlal in January.

    For now, the coach is listening to offers from clubs that are interested in his services and he was at some point linked with Orlando Pirates as a possible replacement for Jose Riveiro.
