BackpageThere is a slight reprieve for Durban City as the Premier Soccer League has dismissed a case that had been lodged against them by JDR Stars over the eligibility of Saziso Magawana.
The PSL was scheduled to meet on Tuesday and, after doing so, dismissed the case that JDR Stars had made over the eligibility of Magawana, who signed for Durban City from Marumo Gallants.
BackpageThe PSL prosecutor, Advocate Zola Majavu, confirmed the dismissal of the JDR Stars' protest case.
"I can confirm that a short while ago, the PSL DC concluded a protest that was lodged by JDR Stars against Durban City in respect of a player, Mr. Magawana," Majavu said.
"Having listened to the evidence presented by the protesting club and the submissions made by all parties, the PSL DC dismissed that particular protest with costs to be paid by the protesting club, JDR Stars," he added.
"In essence, the effect of that decision is that the PSL DC found nothing wrong with the registration of Mr. Magawana by Durban City, and to the extent that he was fielded against JDR Stars, there was no wrongdoing as determined by the DC.
"As matters stand currently, the protest by JDR Stars against Durban City stands dismissed."
BackpagepixThe league's prosecutor said another case launched against Durban City by Cape Town Spurs is yet to be determined.
"However, late yesterday afternoon, we received a further protest from Cape Town Spurs in respect of the same Mr. Magawana. That particular protest was also enrolled for tonight immediately for proceeding after the earlier one pertaining to JDR Stars," Majavu revealed.
"The legal representatives for Cape Town Spurs requested that the matter be postponed to tomorrow to enable them to make their witness statement tomorrow. The league did not object to the request for the postponement, nor did Durban City," he added.
"In the result, the matter is scheduled to proceed tomorrow. The decision will then be made regarding that particular protest by Cape Town Spurs.
"Out of an abundance of caution, the league, represented by myself as the prosecutor, directed all parties involved in this matter that in the event they wished to exercise their appeal rights, such appeals must be referred directly and immediately to arbitration."
BackpageAlthough they have won the first case, Durban City, formerly Maritzburg United, cannot breathe a sigh of relief before the other matter is determined.
Meanwhile, during the season, Durban City defeated both Cape Town Spurs and JDR Stars, and the wins were crucial in their promotion quest.
Against JDR Stars, Durban City collected six points as they were 5-2 winners on November 11 before a 3-0 victory later on May 4.
Durban City also defeated Cape Town Spurs 1-0 in both league games, first on September 27 and then on May 18.
BackpageAfter winning their case against JDR Stars, their eyes are now on the Cape Town Spurs case, which will be determined in the next 24 hours.
Thereafter, it will be clear whether JDR Stars or Cape Town Spurs will launch appeals against the decisions by PSL DC.
