FAM's application to strike out Annuar's summons is dismissed with cost

The FAM's application's to strike Annuar's orginating summons has been dismissed by the High Court and Judge Hadhariah Syed Ismail has set Feb 25th to hear the case
The High Court has dismissed with cost the application by the Football Association of Malaysia (FAM) and its secretary-general Datuk Azzudin Ahmad, to strike out an originating summons filed by Tan Sri Annuar Musa over his suspension from football activities.

Judge Hadhariah Syed Ismail has made the decision in her chambers and set February 25th, to hear the case.

According to Bernama, Annuar's counsel Yusfarizal Yussoff told reporters outside the court that the judge has dismissed the application since there was merit in Annuar's suit.

Annuar is seeking a declaration that the first two charges against him, were flawed, invalid, and void. Annuar also claimed FAM also failed to satisfy the burden of proof on the charges against him, which he acclaimed that it was prejudicial as he was found guilty of violating the FAM Edisi 2011 code before his defence was filed.

He also claimed that he was not given the right to be presented during the hearing.

On June 4th 2012, Annuar was slapped with a 30-month suspension by the FAM Disciplinary Commitee after finding him guilty of making a negative statement of the national football team in the media on February 12th, 2012.
