However, under the FA's new 'not seen' pilot scheme, Riether is able to be charged as the incident had been caught on camera.
Previously in similar incidents, the referee of any given match would be asked to review video evidence after the game and decide what action he would have taken, but the new initiative, a three-person panel of ex-officials will rule on the correct course of action.
With all three members of the panel agreeing that the incident warranted a red card for Riether, the 30-year-old has been charged as a result.
The German has until 18.00BST on Tuesday to inform the association of his response.
