Mohun Bagan have obtained a restraining order from a city court in Kolkata against the All India Football Federation (AIFF), which prevents the national football authority from stopping the Mariners from participating in the I-League.

The Kolkata based club took this route after the AIFF “deferred” their game against the Pailan Arrows, which is to be held this weekend, as they deliberated over the action that needed to be taken with regards to the game between Mohun Bagan and East Bengal on December 9, 2012. That game had been suspended at half-time, as Karim Bencherifa’s side refused to take to the field, citing security concerns.

The city civil court’s seventh judge Sandip Chaudhury, taking up an ex-parte petition by Bagan filed against the CEO of the I-League, restrained AIFF from taking any decision on the issue without giving Mohun Bagan opportunity of being heard.

The matter would come up before the court again on January 11.

Gitanath Ganguly and Sourav Ganguly, the counsels appearing in favour of the Mariners, submitted the petition that the national authority should be prevented from taking any arbitrary decision against their client.

The AIFF was mulling action against the club based on their constitution’s clause 22, according to which a team can be suspended from the rest of the league season and the following two campaigns, if it withdraws mid-way through a match, unless it was dubbed a ‘force majeure.’

While Mohun Bagan have been defending their decision to walk away at half-time based on a FIFA rule that states that if a missile of any kind lands on the ground or if a player is injured, then a team has every right to walk off, in this case, they played out the remainder of the first half added time, after Syed Rahim Nabi had been taken off the field, injured.
